Terms of Service

In these terms, "Birthday Buddy", "we", "us", and "our" mean SSS Tech LLC operating the Birthday Buddy service. "You" means you, the person using it.

The service

Birthday Buddy is a WhatsApp companion. It tracks the birthdays and the anniversaries of people you choose to import, reminds you before each one, and drafts a message for the occasion written to sound like you. It lives inside WhatsApp. There is no app to install.

You need a WhatsApp account to use it. WhatsApp is run by Meta, and your use of WhatsApp is governed by Meta's own terms.

Optional extras you turn on yourself

Some parts of Birthday Buddy are off until you ask for them, and each one stays off until you do.

• Voice notes. You can send a voice note instead of typing. We transcribe it so we can act on what you said.
• The device link. Pro members can link a device so Birthday Buddy can learn the way you write from your own WhatsApp conversations. It reads both sides of those conversations. It is opt in, you can revoke it at any time, and the privacy policy sets out exactly what it reads, what is kept, and how long for. Turning it on means you confirm you are comfortable with that.

Your account and your contacts

When you import a contact, you are telling us you have the right to add that person's details. You are responsible for the contacts and the dates you import and for what you send to the people you know.

Acceptable use

Please use Birthday Buddy for what it is for: keeping up with the birthdays and the anniversaries of people in your life. Do not:

• Use it to spam, harass, or message people who do not want to hear from you.
• Import contact data you do not have the right to use.
• Try to break, overload, reverse engineer, or abuse the service.
• Use it to break the law or to break WhatsApp's or Meta's rules.

We can suspend or end your access if you misuse the service.

Drafts are suggestions

Birthday Buddy drafts messages for you, for birthdays and for anniversaries alike. The drafts are suggestions. You decide what to send and you send it yourself. You are responsible for the final message that goes out under your name.

Subscriptions and billing

Birthday Buddy is free to try. Pro unlocks the full experience.

• Price. Pro is $2.99 per month, or $29.99 per year.
• Trial. New members get a 14 day Pro trial. If you do not continue, you drop back to the free experience.
• Renewal. The monthly plan renews each month and the yearly plan renews each year, until you cancel.
• Cancellation. You can cancel anytime. Message Birthday Buddy to cancel. When you cancel, you keep Pro until the end of the period you have paid for, then it stops renewing.
• Refunds. Payments are generally non refundable except where the law requires a refund.
• Price changes. We may change the price. If we do, we will tell you before it affects you, and you can cancel if you do not agree.

Billing may be handled through a payment processor. Their terms apply to the payment itself.

Disclaimers

We work hard to make Birthday Buddy useful and reliable, but we provide it "as is" and "as available". We do not promise it will be uninterrupted, error free, or that every reminder will arrive exactly when you expect. Reminders depend on WhatsApp and Meta delivering messages, which is outside our control.

To the fullest extent the law allows, we disclaim all warranties that are not expressly stated here.

Limitation of liability

To the fullest extent the law allows, SSS Tech LLC is not liable for indirect, incidental, special, or consequential damages, or for a missed birthday, a message that did not send, or data that did not sync. Our total liability for any claim relating to the service is limited to the greater of the amount you paid us in the 12 months before the claim, or 50 US dollars.

Some places do not allow these limits, so parts of this section may not apply to you.

Changes to the service and these terms

We may change, add, or remove features over time. We may also update these terms. When we make important changes, we will update the date above and let you know in WhatsApp. If you keep using Birthday Buddy after a change, you accept the updated terms.

Ending your use

You can stop using Birthday Buddy anytime and wipe your data with one message. We can suspend or end access if you break these terms or if we need to for legal or safety reasons.

Governing law

These terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict of laws rules. Disputes will be handled in the state or federal courts located in Massachusetts.
